MOO: First Blood Bug

I play MOO a lot, and I do well on Hard, and have multiple
wins on Impossible level. I say this so that you don't
assume I'm a clueless newbie when you respond to my question.

Ok, here's something that pisses me off in about 85% of the
games I've ever played. I usually resolve the situation
favorably in the end, but I wish it would not happen at all.

Here's the scenario:

1. I colonize a planet A

2. An enemy B ship arrives in orbit around planet A

3. Enemy B transports arrive and captured planet A before I
can get sufficient colonists to the planet.

4. My transports arrive and retake the planet.

5. Enemy B informs me that I committed an unwarranted act
of war, and declares war on me.

Additional: Frequently this has happened when Enemy B and I
had a Non-Aggression Pact in place.

Also: In the case of the Non-Aggression Pact, enemy troops
were not sent from Enemy B until AFTER the Pact was signed,
while it states in the rule book that all such attacks will
end immediately upon signing the Pact. Although I realize
that all such attacks which are en route at the time of the
signing will continue regardless of the pact, I should
restate that these attacks were not launched until after
the pact was signed (and I have had Improved Space Scanners
on several occasions with which I could verify this fact).

So here's the questions:

1. Why does an enemy with whom I have a non-aggression pact
   attack and conquer my systems?

2. Why does the enemy's conquering of my planet NOT immediately
   start a war?

3. Why am I penalized diplomatically for starting a war, when
in fact all I did was retake a planet that was justly mine
   to begin with?

It seems to me that the blame for starting the war, and thus
diplomatic penalties for starting a war, and possibly for
breaking a non-aggression pact, should fall upon Enemy B.

It is a minor nuisance at best, and an extreme pain in the
ass at worst. Sometimes one can not afford to be involved
in a war, either because one is already at war, or because
in the early stages of the game the enemy species all have
a distinct materiel advantage over you (especially in the
higher levels).

I guess what I'm really asking is: Has this problem yet been
addressed by a patch? And if so, where is the ftp site?
