Then couldn't id claim lost sales due to the shareware disk vendor misleading the customers? I believe rack vendors now have to clearly state what is and is not shareware, and that an additional fee is required by the author for registration of the product. -- David Sward swa...@cmu.edu GCS: -d+ -p+(---) c++(++++) l+ u+ e+ m+()@ s+/+ n+@ h+ f !g w+@ t+@ r+ y?

Yea they can do that. Plus since it's THEIR program, THEY CAN DO WHATEVER THEY WANT TO DO WITH IT. Demanding that it's to be distributed for free only (or a dollar each disk, limit 5 disks), or any type of condictions. They can do whatever they want cuz it's THEIR program. -Zelpheri *** This SIG is currently under construction. Coming features: More dumb quotes! Neat Elaboration of my alias! [This Space For Rent!]

In the scenario we are talking about, the shareware disk vendor offers unregistered DOOM on disks for $12. Some fool buys it. What false belief does the fool now have? Unless you want to argue that selling shareware disks should be outlawed altogether, you have to say that the fool hasn't been mislead if he is charged $4. I believe rack vendors now have to clearly state what is and is not shareware, and that an additional fee is required by the author for registration of the product. I've seen little stickers with these words. I think we should suppose that the $12 unregistered DOOM disks have these words on them, otherwise the issue would be simpler and the $12 would not be relevant. -- Tim Freeman <t...@cs.cmu.edu> Do you call yourself free? Well it's this simple : There's this file called VENDOR.DOC (or something to that effect) Now, id probably says something like : "You may not charge more than $x for this product" or "You must get written permission from us if you want distribute this"... If someone would just post the relevant part of this file then we don't have to keep this thread about wether it's right or wrong going anymore. (In there's no vendor.doc it's probably in the regular docs) ^^ if -- | Mitch Burton | Think of it | | pel...@netcom.com | as evolution | | pel...@io.com | in action |

Contents of VENDOR.DOC included with the Shareware DOOM:
NOTICE TO VENDORS: IN ORDER TO COMMERCIALLY DISTRIBUTE OR IN
ANY WAY DISTRIBUTE THIS PROGRAM, YOU MUST FIRST EXECUTE ID
SOFTWARE, INC.'S VENDOR'S LICENSE. YOU MAY OBTAIN A COPY OF THE
VENDOR'S LICENSE BY WRITING TO: ID SOFTWARE, INC., 18601 LBJ
FRWY., SUITE 615, DALLAS, TEXAS 75150. DO NOT CALL!
That's it. So, if any vendor distributes the game without FIRST contacting
ID...they've broken the law, period. In this way, ID can keep track of
who is legally and who is illegally distributing their game. Downloading
from a ftp site or BBS doesn't apply because they aren't vendors, unless
the BBS charges fees for access.
IMHO, this was a REAL clever way of handling the situation...
