What makes you think he's cheating? Alothough he may have, just becasue your stats are 
maxed does not make you a cheater. I have (on Battle.net) a Level 37 Sorcerer and just 
finished maxing out a couple of days ago. So it is possible to max out without cheating.
The part about the level up buttons staying there is suppose to be fixed on the next 
patch/update. Blizzard has said they are working on that problem.
Although I dont care for all the cheaters on Battle.net we must not be too hasty in 
our judgement.
