Well, you're right that a raid tank should never threat cap their DPS.
If this is the case they have to change gear/rotation, whatever.
However, if we are talking about 10 man raiding without misdirect/tricks
available, DPS can pull aggro when they unload all CDs in the first few
seconds. There is one reason for this: Vengeance. This mechanic is
Blizzards idea of letting tank threat scale better with gear than in
previous expansions, but the implementation is very flawed. Let me explain.

To stack vengeance, a tank has to be damaged. This is fine, but of
course means that for the full TPS of a tank to reach its potential,
they need time. After some 20-30 seconds in a standard raid encounter,
my paladin gets around 13k AP from vengeance. This means my threat is
through the roof, no DPS will ever get near me if there is no outside
influence. On the other hand, this means any kind of threat stat
(Expertise and Hit, most importantly) is completely useless for tanks
atm., so smart tanks will always reforge away from those. This increases
the pull problems, unfortunately, as you have a situation of low
vengeance/AP AND low hit/exp. So not only do my attacks hit like wet
noodles in the beginning, but they also miss quite often.

This is why smart DPS watch omen in the beginning and only start
unloading the first round of cooldowns with an established threat lead.
One could argue that the tanks should stack some exp/hit to counter
this, but as said above in a typical 6 minute encounter, after 10-15
seconds threat stats are completely wasted and could better be invested
in mitigation and thus healer mana.

Vengeance is a solution to a big problem of earlier expansions, but
stupidly implemented at the moment. Tank threat in raids is completely
reliant on stacking it. Without V you have no hope of holding aggro,
with it it is trivial and you mostly have no influence when and if you
can stack it.
